Resolution 2023-02 – A Resolution in Support of a City of Burlington, Wisconsin Proposal, Requesting the State to Allow the Transfer of a “Class B” Liquor License Throughout the Entire County, Rather than Being Limited To A 2-Mile Contiguous Radius.

RESOLUTION NO. _2023-02_

 

A RESOLUTION IN SUPPORT OF A CITY OF BURLINGTON, WISCONSIN PROPOSAL, REQUESTING THE STATE TO ALLOW THE TRANSFER OF A “CLASS B” LIQUOR LICENSE THROUGHOUT THE ENTIRE COUNTY, RATHER THAN BEING LIMITED TO A 2-MILE CONTIGUOUS RADIUS.

 

WHEREAS, the Wisconsin State Legislature has set forth quotas the number of “Class B” Liquor Licenses a municipality may grant or issue in sec.125.51(4), Wis. Stats.; and

WHEREAS, the Wisconsin State Legislature allows for a number of Reserve “Class B” liquor licenses are licenses that were not granted or issued by a municipality on December 1, 1997, but are counted as a reserve under the calculations described in sec. 125.51(4)(br), Wis. Stats.; and

WHEREAS the Wisconsin State Legislature allows a municipality to transfer up to three reserve “Class B” liquor licenses to a municipality that is contiguous or within two miles of the transferring municipality; and

WHEREAS the transferring municipality establishes the initial issuance fee in an amount not less than $10,000. Upon receipt of the issuance fee, the receiving municipality must pay the issuance fee to the transferring municipality; and

WHEREAS a transfer of a reserve “Class B” license to another municipality is permanent. Once transferred, the receiving municipality’s quota is increased, and the transferred municipality’s quota is decreased; and

WHEREAS, the Town of Troy currently has three (3) reserve “Class B” licenses that are unused and are unlikely to be used under the current restrictions outlined above; and

WHEREAS, the City of Burlington has noted in their request for support the difficulties of increasing their reserve “Class B” license quota by increasing the population by 500 residents if they are unable to support potential new businesses due to the current restrictions outlined above; and

WHEREAS, the Town Board finds that it would be of significant financial benefit to the Town of Troy and other municipalities in the county and state if the current restrictions on the transfer of reserve “Class B” licenses were altered to allow the transfer of unused reserve “Class B” licenses to occur between any two (2) municipalities within a county regardless of physical proximity:

NOW, THEREFORE, be it hereby resolved by the Town of Troy, Walworth County, Wisconsin, supports the City of Burlington, Walworth County in its effort to petition the Wisconsin State Legislature to change the regulation of the transfer of reserve “Class B” licenses to allow the transfer of unused reserve “Class B” licenses to occur between any two (2) municipalities within a county regardless of physical proximity:

Section 3.  Effective Date.  The Resolution shall be effective upon its adoption and approval.
